Terms and Conditions of The Kingdom
The present terms and conditions (hereinafter referred to as “Terms”) govern the use of the website fans.donomar.com (hereinafter referred to as “Website”) by users (hereinafter referred to as “You” or “Your”) and its store hosted at storedonomar.com.
1. Agreement
(Hereinafter referred to as "we," "us," or "our"). Please read these Terms carefully, as they affect your legal rights and responsibilities. If you do not agree to these Terms, please do not access or use the Website or any of the services offered under the brand TheKingdom®. If you have any questions about these Terms, we kindly ask you to contact us at support@donomar.com.
2. Description of the Service
Subscription to a digital platform that provides exclusive audiovisual content by the artist Don Omar, as well as the possibility of obtaining a ticket for physical entry to live concerts, among other experiences with or without the artist's presence.
Our services also include the sale of official merchandise by Don Omar through our digital platforms and onsite at the Official Stand (VIP section). Additionally, TheKingdom® offers exclusive events called "Experiences," which will take place occasionally and have limited capacity based on the conditions of the venues where the shows are held and the internal management and organization of The Kingdom's operations team.
Below are the specific terms and conditions applicable to the services offered as "Experiences" by TheKingdom®:
2.1. Terms and Conditions: Ticket Presale
2.1.1. Through the presale, The Kingdom® offers Don Omar fans the opportunity to obtain a one-year membership to The Kingdom, which includes a VIP package featuring exclusive official merchandise by the artist, access to the VIP lounge, a Meet & Greet with the artist, and the chance to participate in the ticket presale for shows before the official event ticketing platform opens to the public. Upon purchasing presale access with The Kingdom, each member will receive a unique code identifying them as an active member. This code will grant direct access to the ticket presale on the corresponding ticketing platform.
2.1.2. Users can exclusively purchase presale access through the official platform: https://experiences.donomar.com/.
2.1.3. The presale is subject to the capacity of the venue where the event will be held and will comply with applicable regulations.
2.1.4. The presale is only available to active members of The Kingdom®, who will be subject to an additional cost for the ticket, regardless of their subscription.
2.1.5. During the presale, each user may purchase up to six (6) tickets per transaction unless a different limit is specified for a particular event.
2.1.6. The event organizer reserves the right to apply additional service fees if necessary.
2.1.7. The ticket purchase will only be considered valid once the payment has been approved and credited to the organizer’s account.
2.1.8. No cancellations or refunds will be allowed once the ticket purchase has been confirmed.
2.1.9. Neither The Kingdom®, the artist Don Omar, nor the event production team will be responsible for the transportation of attendees to the event venue.
2.1.10. Neither The Kingdom® nor Don Omar will be responsible for incidents that may occur at the venue during the show.
2.1.11. By completing the payment process for the presale and subsequently for the tickets, the user agrees to these terms and conditions.
2.1.12. The presale is limited to active members of The Kingdom® with a valid membership at the time of the presale. The conditions, dates, and other details of the presale will be communicated via the email registered by the user, as well as through The Kingdom's official social media channels. Notifications may also be sent through the membership's unique code identifying the user as an active member.
2.1.13. Ticket purchases during the presale are subject to availability and do not guarantee access to the event if tickets sell out. If the user does not complete the purchase during the presale period, they must wait for the general sale to attempt to buy tickets.
2.2.- Terms and Conditions: Tickets TheKingdom®
2.2.1.- Complimentary tickets for members with an active annual subscription will not be available for all of the artist's shows. The Kingdom® will announce, through its official channels (email, website, and social media), the shows where this benefit will be available, as well as the procedures and conditions to access it.
2.2.2.- Specific details about the process for requesting and delivering complimentary tickets, as well as the applicable terms, will only be communicated when the benefit is enabled for a particular show. Users must follow the instructions provided in the official announcements to access the benefit.
2.2.3.- The Kingdom® obtains the complimentary tickets for each show through the official producers and ticketing platforms of the venues where Don Omar’s shows take place. Once the The Kingdom® team receives or the official tickets for the show are enabled, they will be immediately sent via any of the aforementioned methods to the members who have correctly redeemed their complimentary tickets. The user acknowledges and accepts that the delivery timelines for the complimentary tickets are subject to this clause.
2.2.4.- Complimentary tickets are subject to limited availability. Users who meet the requirements and successfully complete the redemption process on the website fans.donomar (while the quota is available) will be able to access the complimentary ticket benefit. It is important to note that if a user has already redeemed one (1) experience during their annual membership period, they will not be allowed to redeem again within the same period. If a user wishes to access two (2) of the artist's shows under this "complimentary ticket" modality or two experiences for annual members of The Kingdom®, they must create a new user account and acquire a new annual membership. This is intended to expand the opportunities for all annual members to access this and other benefits.
2.2.5.- Buyers of these tickets WILL NOT be able to request the cancellation or refund of their purchase.
2.2.6.- The Kingdom®, the artist, or the event production team are not responsible for the transportation of the beneficiaries to the concert venue.
2.2.7.- The Kingdom® and/or the artist are not responsible for incidents that may arise or occur at the venue on the date of the concert.
2.3. Terms and Conditions: Backstage Tour
2.3.1. The Kingdom® offers users with an active annual subscription the chance to participate in the Backstage Tour in their selected city. This experience consists of a guided tour behind the scenes of the show, including workspaces, technical equipment, and/or production meetings.
2.3.2. Users can reserve their spot through the website fans.donomar.com. The number of participants allowed in the experience will be determined based on the city, show date, available experiences at the venue, and decisions made by The Kingdom® team.
2.3.3. The experience DOES NOT INCLUDE concert admission. Participants of this experience must already have access to the show independently of this tour. Additionally, after the experience, they may be required to exit the venue and re-enter with the general public, according to the security policies of each venue.
2.3.4. Neither The Kingdom®, the artist, nor the event production team will be responsible for the transportation of participants to the concert venue.
2.3.5. The Kingdom®, the production team, the venue, and/or the artist will not be held responsible for incidents that may occur at the venue on the concert date or during the experience.
2.3.6. By submitting the application form for this experience, the user agrees to these terms and conditions.
2.3.7. If the user arrives later than the designated time, the experience cannot be rescheduled, as it is conducted at a specific time and day prior to the show.
2.4. Terms and Conditions: Meet & Greet
2.4.1. The Kingdom® offers users with an active annual subscription the chance to participate in a Meet & Greet with the artist Don Omar. This experience includes a pre-show meeting with the artist, where fans can meet him, take photos, and share an exclusive moment.
2.4.2. Users can reserve their spot through the website fans.donomar.com.
2.4.3. The number of participants allowed in the experience will be determined based on the venue's capacity, city, show date, available experiences at the venue, and decisions made by The Kingdom® team.
2.4.4. If the Meet & Greet must be canceled or rescheduled due to circumstances beyond The Kingdom® team’s control, efforts will be made to notify subscribers as far in advance as possible.
2.4.5. Purchasers of the Meet & Greet experience CANNOT request cancellations or refunds.
2.4.6. The experience DOES NOT INCLUDE concert admission. Participants must already have access to the show independently of this experience.
2.4.7. Neither The Kingdom®, the artist, nor the event production team will be responsible for the transportation of participants to the concert venue.
2.4.8. Neither The Kingdom® nor the artist will be held responsible for incidents that may occur at the venue on the concert date or while fulfilling tasks related to the experience.
2.4.9. By submitting the application form for this experience, the user agrees to these terms and conditions.
2.5. Terms and Conditions: MEMBER KIT (Includes: One (1) signed poster, One (1) original CD of the "Back to Reggaeton Tour" and One (1) artist T-shirt in size "Large")
Upon subscribing to our service, subscribers will receive:
One (1) signed poster, One (1) original CD of the "Back to Reggaeton Tour" and One (1) artist T-shirt in size "Large".
After subscribing, you will receive an email with instructions on how to claim your MEMBER KIT, including a link to complete shipping details and pay for shipping costs. Once the process is complete, the MEMBER KIT will be shipped to your address.
Members must make the purchase using the same email they used to subscribe to The Kingdom® at fans@donomar.com. Otherwise, the system will not grant access to the product at no cost.
The MEMBER KIT is only available to users with an active standard subscription ($49.99) who have not yet redeemed the kit.
The stock is limited to one (1) MEMBER KIT per member. Additional orders will be canceled.
SPECIAL SUBSCRIPTION OFFERS: The Kingdom® may offer limited-time promotional memberships at a price lower than the regular $49.99 subscription fee. These promotional offers will only include access to The Kingdom® and will not include the MEMBER KIT.
2.6. Right to Cancel Purchase
Once a ticket or experience purchase has been accepted and payment has been made, no refunds or cancellations can be requested. Users may only request a cancellation and refund of the cost if the event is definitively canceled (without rescheduling) by the producer and/or event organizer.
If the date of an event changes due to unforeseen circumstances, the ticket for the show or experience will remain valid for the new date set and communicated by the organizer. Rescheduling of the event does not entitle the user to a refund of the purchase price.
Service fees effectively provided by The Kingdom® will not, under any circumstances, be refunded to the customer.
3. Subscription and Automatic Renewal
These terms and conditions outline the subscription policies applicable to all users who purchase membership products or services through our platform https://fans.donomar.com.
Your subscription to our membership includes enrollment in an annual payment plan as applicable. Your subscription will automatically renew at the end of the indicated billing period unless you cancel it according to the cancellation instructions provided below, without penalties or additional charges for early termination.
The payment will be charged to the payment method you selected at the time of purchase at the start of each new billing period unless you cancel in due time.
Your “billing period” refers to the interval between each recurring billing date corresponding to your subscription term. To view your next recurring billing date, log in to your account and check the details in the settings section.
4. Acceptance
By creating an account, watching videos, making a purchase, downloading branded apps, or engaging in any other interaction, visit, or use of any The Kingdom® services, the user agrees to this agreement and consents to contract with us electronically.
We reserve the right to update these Terms at any time. Any modifications will be properly notified via an announcement on the Website and other communication channels. It is your responsibility to check for such changes.
The modifications will apply to the use of the Website and Store once we have made the announcement. If you do not agree to the new Terms, you must stop using our services.
If you continue using any of our services after the date the modifications take effect, your use of The Kingdom® Website will indicate your agreement to be bound by the new Terms. Similarly, the user acknowledges and accepts that we will not be held responsible for any modifications, temporary or permanent withdrawals of any user-generated content shared via the interaction channels enabled on our digital platforms under The Kingdom® brand.
You may terminate the Agreement at any time by deleting your account through our support channel at support@donomar.com.
We reserve the right to suspend or terminate your account for non-compliance with these Terms. If The Kingdom® deletes your account due to a breach, you will not be allowed to register again.
ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE KINGDOM WEBSITE, DON OMAR STORE, AND ANY OTHER PRODUCTS DEVELOPED AND OFFERED BY THE KINGDOM.
5. Subscription Modification, Cancellation, and Refund Policy
You can modify or view your personal registration information at any time from your account settings after logging in.
You may cancel your subscription at any time before the current billing period ends. You must cancel at least 48 hours before renewal to avoid another charge.
Once the subscription or automatic renewal charge has been processed, the user has a period of 24 hours to request cancellation with a right to a refund. After this period, the user may cancel their subscription without the right to a refund of the processed charge.
You can contact our support channel directly at support@donomar.com. Cancellation will take effect at the end of your current billing period, and you will retain access to the service until then.
We do not provide refunds or credits for unused portions of annual billing periods. Service fees effectively provided by The Kingdom® will not, under any circumstances, be refunded, even in cases of suspension, cancellation, or rescheduling of the event.
6. Registration
You guarantee that the personal information provided during registration is true, accurate, current, and complete in all respects and that you are not impersonating any other person or entity.
Products or services purchased on any The Kingdom® platforms are exclusively for private and personal use and are not for resale.
You must notify us immediately of any changes to your personal information by sending a message to support@donomar.com.
7. Online Purchases
Product Availability:
All purchases are subject to acceptance and availability. If the requested goods are not in stock, a similar product that meets the acquired characteristics will be delivered. Any online order will be treated as an offer to purchase our tangible or intangible goods. We reserve the right to reject any offer at any time. As a user, you agree that any automatic notification acknowledging receipt of your order does not constitute acceptance of your offer to purchase products or services from our website.
A contract between you and The Kingdom® will be formed when we charge your debit or credit card or when the purchased goods are delivered. We are committed to keeping your order and payment details secure; however, we cannot be held responsible for any loss you may incur due to unauthorized access to your data.
Goods or services purchased through the website may not be resold or distributed. We reserve the right to modify or discontinue any item without prior notice.
Pricing and Payment:
All prices displayed are in United States Dollars (USD) and are accurate at the time of entry into the system. We reserve the right to change prices at any time without prior notice. Payments can be made using internationally accepted credit or debit cards.
If your payment is not processed successfully, we reserve the right to attempt processing again within 48 hours. You confirm that the card you use is yours. Cardholders are subject to validation and authorization checks by the card issuer. If payment is declined, we will not be responsible for any delay in the delivery of your order.
We reserve the right to enable additional payment methods, governed by specific terms and conditions. If discount codes are enabled, their use will be subject to specific conditions. Please request a copy of the discount code terms and conditions from our Customer Service team.
Delivery:
Delivery will be made in accordance with the purchase details and may vary based on location and external factors. Intangible goods will be delivered via email or other authorized means.
Shipping services are fully outsourced and are not part of the services offered by The Kingdom®. Any claims regarding the condition or loss of a package must be communicated to and addressed by the shipping company responsible.
Product Exchanges and Returns:
Returns or exchanges will only be accepted for factory defects reported immediately to the The Kingdom® team at the point of purchase.
8. On-site Purchases (Exclusive Official Merchandising - VIP Section)
Product Availability:
Products available at events/shows are subject to availability and will be sold while supplies last. They may not be resold or distributed. We reserve the right to modify or discontinue any item without prior notice.
Pricing and Payment:
Prices at shows may differ from online prices. Accepted payment methods will be indicated at the point of sale. If discount codes are enabled, their use will be subject to specific conditions.
Delivery:
Shipping services will not be provided. Products must be collected at the point of sale.
Returns and Refunds:
No returns or refunds will be accepted, except for manufacturing defects.
8.3. Intellectual and Industrial Property Rights:
The content of The Kingdom® is protected by copyrights, trademarks, databases, and other industrial and intellectual property rights. You acknowledge that the material provided and included as part of the Website and Store is our property or that of our licensors.
In appropriate circumstances, and as defined by The Kingdom®'s organization, accounts of individuals who violate these policies will be canceled.
9. Limitation of Liability
We exclude any liability in relation to the following:
Incompatibility of the Website with any of your devices, software, or telecommunications connections.
Technical issues, including errors or interruptions on the Website.
Unsuitability, unreliability, or inaccuracies of the Website in meeting your purchase requirements.
To the fullest extent permitted by applicable law, you agree that we will not be liable to you or any third party for consequential or incidental damages (including, but not limited to, pure economic loss, loss of profit, business loss, loss of anticipated savings, wasted expenditure, loss of privacy, and loss of data) or other indirect, special, or punitive damages of any kind arising from or related to any of The Kingdom® platforms.
10. Prohibited Technical Measures
You shall not:
Except as authorized by law or permitted by us: extract, reproduce, redistribute, create derivative works, decompile, reverse engineer, alter, archive, or disassemble any part of the The Kingdom® Service or Be Smart Mobile LLC.
Attempt to bypass any of our security measures, rate limitations, filtering, or digital rights management controls.
Transmit any malicious programs, scripts, or code.
Send an unreasonable number of requests to our servers.
Take any other actions to manipulate, interfere with, or damage The Kingdom® or Be Smart Mobile LLC services.
11. Arbitration Agreement
These terms and conditions establish a binding arbitration agreement between you and Be Smart (the "Arbitration Agreement"). In this Arbitration Agreement, you agree to: Arbitrate all claims related to the Be Smart Service, Waive your right to a jury trial, Waive any right to proceed on a class basis in arbitration or otherwise.
The exclusive method for resolving any dispute or claim arising from or related to this Agreement (including any alleged breach thereof) or your use of Be Smart Mobile LLC (The Kingdom®) will be BINDING ARBITRATION, administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures, as modified by our Arbitration Procedures.
Arbitration provides a private dispute resolution process that is often faster and less formal than litigation. In arbitration, your rights will be determined by a neutral third party called an arbitrator, not by a judge or jury. Both you and Be Smart are entitled to fundamentally fair proceedings at all stages of the arbitration, including the hearing (if applicable).
The arbitrator will decide all matters related to the dispute, including the issue of arbitrability, and may award any relief a court could award. The arbitrator's decisions are enforceable in court and may only be overturned by a court for very limited reasons.
